These terms and conditions ("Terms") govern your use of our website safi-iraq.com ("Website") and our mobile application (Safi, Safi Captain, Safi Restaurant) ("Application"). The Website and Application together are referred to as the "Platform", provided to you by Alebtkar Aljadeed Company (we, us, our company). Please read these Terms carefully before using the services on our Platform. If you do not agree to these Terms, please do not use the Platform. By downloading, installing or using the Platform, you agree to these Terms and other policies (including the Cancellation and Refund Policy, Privacy Policy, etc.) as published on the Platform, effective from the date of your first use.
1. Use of the Platform and Services
1.1 Commercial Terms:
All commercial and contractual terms are displayed and agreed upon between customers and store and restaurant owners only. This includes, but is not limited to, price, taxes, shipping costs, payment methods, payment terms, delivery dates, warranties and after-sales services. Our company does not interfere in these agreements between customers and store and restaurant owners. However, we may provide support services to store and restaurant owners in terms of fulfilling orders, collecting payments, and customer service according to separate contracts with store and restaurant owners.
1.2 Facilitator's role:
The Alebtkar Aljadeed company through the platform only acts as a facilitator for transactions between customers and store and restaurant owners. We do not own or obtain any rights to the products and services provided by store and restaurant owners on the platform. We are not responsible for non-performance, unsatisfactory services, or delays resulting from reasons such as stockouts, unavailability, or delayed orders.
1.3 Account Creation:
Users must create an account to use our services. We may collect personally identifiable information, including your name, phone number, and email address to create your account. It is your responsibility to ensure that the information you provide is accurate and up-to-date.
2. Prohibited Activities
2.1 Illegal Activities:
You may not use the platform for any illegal purpose or in violation of any applicable laws or regulations.
2.2 Infringing Content:
You may not post content that violates the intellectual property rights, privacy, or other rights of any party.
2.3 Abusive Behavior:
It is prohibited to post content that is illegal, defamatory, threatening, harassing, or abusive.
2.4 Impersonation and Providing False Information:
It is prohibited to impersonate another person or provide false information on the Platform.
2.5 Spam and Malware:
It is prohibited to post spam, links to external sites, or any type of code.
2.6 Unauthorized Use:
It is prohibited to allow others to use your account to post or view comments.
2.7 Data Collection:
It is prohibited to collect information about other users without their consent.
3. Payment and Refund
3.1 Payment Methods:
Alebtkar Aljadeed Company reserves the right to introduce additional payment methods or remove existing payment methods at any time. Payments are processed through third-party payment service providers, and Alebtkar Aljadeed Company does not retain your payment information.
3.2 Use of Credit/Debit Cards:
You must provide accurate credit/debit card information for payment processing. Unauthorized use of credit/debit cards is prohibited and Alebtkar Aljadeed Company disclaims any liability for any unauthorized transactions.
3.3 Refunds and Cancellations:
Refunds, chargebacks and cancellations are managed in accordance with our Cancellation and Refund Policy. We are responsible for processing payments made through the Platform, in accordance with these Terms.
4. Delivery and Fulfillment of Orders
4.1 Delivery Address:
Orders will be delivered to the address you provide when placing the order. Changing the delivery address may result in the order being cancelled and additional delivery charges may apply.
4.2 Delivery Instructions:
It is your responsibility to provide clear instructions and authorization for delivery. Failure to do so may result in the goods being deemed delivered and you may not be eligible for a refund.
4.3 Estimated Delivery Time:
The estimated delivery time quoted when confirming the order is an estimate and may vary. Alebtkar Aljadeed Company is not responsible for delays caused by the merchant or unforeseen circumstances.
5. Amendments to the Terms
Alebtkar Aljadeed Company reserves the right to change or modify these Terms at any time by posting updates on the Platform. Your continued use of the Platform after such changes indicates your acceptance of the modified Terms.
6. Limitation of Liability
Alebtkar Aljadeed Company is not responsible for any direct, indirect, incidental or consequential damages arising from the use of the Platform, including but not limited to damages related to the quality of the product, the services of the restaurant or store owner, or delivery delays.
7. Termination of Use
Alebtkar Aljadeed Company may terminate or suspend your access to the Platform at any time for breach of these Terms or for any other reason, with or without notice.
8. Applicable Law
These Terms shall be governed by and construed in accordance with the laws of Iraq without regard to its conflict of laws principles.
